Il a ajouté : "Pour la plupart des Québécois, l'acquisition d'une résidence est l'investissement le plus important qu'ils feront au cours de leur vie. Il est donc primordial de les protéger par une réglementation adéquate, laquelle, par ailleurs, ne doit pas constituer un frein au développement du secteur. Cette nouvelle loi et sa réglementation contribueront à atteindre et à maintenir cet équilibre." Une nouvelle entité, l'Organisme d'autoréglementation du courtage immobilier du Québec, remplacera désormais l'Association des courtiers et agents immobiliers du Québec.
Cet organisme, dont l'unique mission sera de protéger le public, pourra compter sur un renforcement des mécanismes du syndic, du comité d'inspection et du comité de discipline. Il pourra agir à titre de conciliateur-médiateur et son service d'assistance, lequel a reçu près de 2 000 demandes en 2009, est maintenant officiellement reconnu dans la législation.

Les courtiers seront désormais solidairement responsables, avec l'agence qu'ils représentent, de préjudices qui pourraient découler d'un contrat de courtage. Cette nouvelle loi prévoit également l'obligation pour les courtiers et les agences de détenir une assurance responsabilité en plus d'assujettir les courtiers qui débutent à certaines règles particulières, le temps qu'ils acquièrent l'expérience nécessaire.
Par ailleurs, seule une personne physique pourra dorénavant être titulaire d'un permis de courtier tandis qu'une personne ou une société pourra être titulaire d'un permis d'agence immobilière ou hypothécaire. "Ces clarifications devraient permettre au public de mieux comprendre le rôle de chacun", a précisé le ministre des Finances.
